Hello, I'm Sarah! Living in Quebec, Canada, I am a lifelong artist who specializes in the design and illustration of characters and creatures. In addition to my innate enthusiasm for visual arts, I am academically trained (bachelor's) and have worked in a few video game studios before becoming a freelance artist. I. GENERAL

  1. By ordering a Commission, The Commissioner agrees to these terms.

  2. The Artist reserves the right to stop working on a Commission, or cancel a Commission request due to poor communication, rude/inappropriate behavior, an inability to effectively communicate in English/French, or a breach of these Terms of Service.

  3. The Artist has the right to alter their terms of service at any time. New rules will not apply retroactively and won't influence orders started on older terms.

II. TOPICS

  1. The Artist will not create any depiction of sexually explicit materials (i.e., “x-rated”, pornographic, simulated sex, or sexual arousal), fetishes, or any form of hateful, racist or gory imagery.

  2. The Artist is willing to depict tasteful nudity/sensuality, a reasonable amount of blood/violence, anthropomorphic characters (furries) when they are not depicted in a sexual manner.

  3. The Artist reserves the right to turn down any commission that makes them uncomfortable, even if it appears to adhere to these conditions.

III. ORDERING

  1. The prices that appear on the commission page are approximates. Each quote will be tailored to fit the individual commission depending on wishes, complexity and character design.

  2. With their order, The Commissioner should provide a a detailed text description, along with links to visual inspiration (reference artwork or pictures from Google Image, for example). Any changes outside of initial project and quote must be discussed and additionally approved. Changes may be individually charged depending on their complexity.

  3. If the order involves multiple Commissioners, a representative should be appointed. I will only invoice, update and deal with the appointed representative.

  4. If the Commission is for Commercial Purpose, it must be notified upfront. Commissions for Commercial use are dealt with differently than those made for Personal use and require a contract. Commercial use of the Commission will be negotiated on a case-by-case basis.

  5. At this time, The Commissioner must have no expectations of when The Commission will be complete, and The Artist does not/ can not give any time frame estimates. If a deadline is desired, it has to be communicated and agreed upon before initial quote. Deadlines affect the price and can be refused.

IV. PAYMENTS & REFUNDS

  1. After both parties agree on the terms and details, the Commissioner has the option to pay for the Commission in full right away, or 50% upfront. Only after a payment has been received will the commission be added to the wait list. The remaining 50% is required after the Commission is completed and the Client has officially approved of the final result. Only when the full payment has been received will the high quality file and ownership of the Commission be transferred to the client.

  2. For more expensive pieces, The Artist may offer payment plans, i.e. payments made in 3 installments or more. This will be decided on a case by case basis.

  3. All payments must be made with Paypal via invoice, which will be emailed to the Commissioner shortly after both parties agree to go forward with the Commission.

  4. All invoices are due within 7 days from receiving them, unless agreed otherwise. Invoices past the due date will be cancelled, also cancelling the commission associated to it.

  5. All prices are expressed in U.S. dollars (USD), and payments are expected to be made as such. The Commissioner is responsible for providing the correct amount, equal to the USD amount. Cryptocurrencies are not accepted as payment.

  6. If a refund is requested after a commission has been ordered and paid for (partially or in full), but before any work on it has been started, 15% of the full price of the Commission will be retained by The Artist to account for processing and managing fees.

  7. If a refund is requested after the work on a Commission was started, the refund will be calculated according to the amount of work that has been done on the Commission at the time of said request.

V. CREATION PROCESS & REVISIONS

  1. The Artist typically works Monday through Friday, and usually takes care of email queries from 10 to 12 AM Eastern Standard time.

  2. For most Commission styles, The Commissioner will be provided with a rough sketch, a refined sketch and a color pass for approval and right to revision. For "Sketch" styles, only a rough sketch will be provided and will be available for revision.

  3. Further complimentary work-in-progress updates may be shared at The Artist's discretion.

  4. After the color stage, the base illustration is considered as "locked in" and the rendering stage starts. No further free revisions are allowed, except for minor adjustments. After this point, major revisions will be either refused, or charged for according to complexity.

  5. Any additional work outside of initial project and quote will either be turned down or charged accordingly.

  6. The Artist typically works through commissions on a "first come first served" basis, going down the wait list in order. However, they reserve the right to choose to work on a commission that has been put on the list after The Commissioner's, if need be.

VI. DELIVERY

  1. Digital Commissions will be handed to the Commissioner via email ; this does not include the Commission native files (e.g., .psd, etc.), unless agreed upon previously. The original file (suitable to print for personal use), and a slightly smaller HD size (for personal online usage) will be provided for the Commissioner's convenience.

  2. Traditional Commissions will be provided to the Client as a high quality scan or photo, via email. If the Commissioner desires to own the original physical artwork, it can be sent to them via postage. The Commissioner is expected to cover any and all shipping fees.

VII. COPYRIGHTS & USAGE

  1. By commissioning The Artist, the Commissioner is purchasing their labor only. The Artist retains all rights to the Commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion, unless otherwise agreed upon. The Artist also retain full copyright of any preliminary designs and incidental works made in the creation of the Commission, unless otherwise agreed upon.

  2. The Commissioner may repost watermarked art at will as long as proper credit to The Artist is included (must include the Artist's artist name (sago)), and include a link to their website and/or to social media pages). The signature must be visible and no profit must be being made.

  3. The Artist does not claim any rights to characters and other intellectual properties used in process of creation.

  4. The Commissioner has the possibility to buy full rights to commissioned artwork. Details will be discussed individually on a case by case basis.

  5. Under no circumstances may the Commissioner submit the Commission to any kind of online or offline contest.

  6. The Commissioner may not edit, alter, or trace the Commission without The Artist's expressed, written permission.

  7. The Commissioner may use the digital (.jpeg, .png or .PDF) file for local printing, so long as it does not breach any Terms and Conditions, and the Commissioner obtains expressed written permission from the Artist prior to printing.

  8. The Commissioner is strictly prohibited from using any original or commissioned art to partake in anything related to crypto art/NFTs.

VIII. OTHER

  1. My private contact information will not be shared with Commissioners.

  2. This contract binds the parties, their heirs, all their successors in interest, and all Client's obligations are attached to the Commission and go with ownership of the Commission, all for the life of the Artist and Artist’s surviving spouse plus twenty-one (21) years, unless otherwise stated.

  3. The Artist has the right to pursue damages under Canadian Copyright Law, should there exist a violation in addition to a breach of these Terms of Service.
